DePuy Orthopedic, a division of Johnson & Johnson, recalled its ASR XL Acetabular System and ASR Hip Resurfacing System in August 2010 after studies showed that, 1) the metal-on-metal systems had an extremely high failure rate which resulted in additional revision surgeries, and 2) that metal debris was being absorbed into patients' organs which may lead to heavy metal toxicity now or years in the future.
DePuy now faces hundreds of product liability lawsuits due to the recall and is seeking to cut its losses by having affected patients sign consent claim forms which would allow the company to obtain valuable information about a case before the individual files a hip implant lawsuit. They say that by signing a DePuy consent form – which is being sent to patients or their doctors by a company called Broadspire – the injured victim may be unknowingly giving up privacy rights and affecting any future claims filed against the company.
